Joint Checks: If contract language allows, checks payable to both the contractor and its subcontractor or material or equipment supplier. Lien (Mechanics Lien): The legal claim of one person upon the property of another person to secure the payment of a debt or the satisfaction of an obligation. Liquidated Damages: A contractually agreed upon amount for contractor delays on a project, which must not be manifestly unreasonable when related to anticipated actual damages for delay as calculated before the beginning of the project. Non-Conforming Work: Work that does not comply with the plans and specifications for the project. Notice to Proceed: Notice issued by a school to the contractor, identifying the date of commencement of the work on a project. Notice to Bidders: Notice informing bidders that a school is receiving bids for construction of a particular project, and describing terms and conditions of the bid. Payment Bond: A bond issued by a surety guaranteeing that if the contractor fails to pay for any labor or materials, the surety will pay for such debts. Performance Bond: A bond issued by a surety guaranteeing performance of the contract and completion of the project. Pre-Bid Conference: May be a meeting or mandatory site walk between the architect, school, and prospective bidders regarding a project. This conference may include questions by the prospective bidders, review of the project site, or give the school the chance to provide additional project information. Preliminary Notice: Notice filed with a school by subcontractors or suppliers 20 days after they furnish services or materials to a job site, alerting the school and original contractor to the claimant’s relationship to the project. Progress Payments: Payments made to a contractor on a periodic basis for work completed after a payment application for the work is approved by the architect, school, and inspector of record. Project Meetings: Pre-construction, construction, and progress meetings to discuss matters relating to a project, such as procedures, progress, problems, change orders, and scheduling. Request for Information: A written request prepared by the contractor asking the architect to provide additional information necessary to clarify an item that the contractor
