or its subcontractors feel is not clearly shown or called for in the drawings or specifications, or to address problems, which have arisen under field conditions. Retention: Percentage of withholding of the contractor’s compensation for work performed on the project until final completion and acceptance of the project. Shop Drawings: Drawings, diagrams, schedules, and other data, which are prepared by the contractor, subcontractors, manufacturers, suppliers, or distributors illustrating some portion of the work on the project. Stop Payment Notice: Notice to a school alleging the failure of the contractor (or a subcontractor) to pay the claimant a specified amount and ordering the school to withhold an appropriate sum from its payments to the contractor. Stop Payment Notice Release Bond: A bond issued by an admitted surety and posted by the contractor in place of funds withheld for stop payment notices. The stop payment notice release bond must be issued by a surety other than the surety that issued the payment bond. Subcontractor: A person or entity who has a direct contract with the contractor, but not the school, to perform a portion of work on a project. Submittals: Shop drawings and physical samples of materials or equipment to be furnished by the contractor to the architect for review and approval before installation or construction. Substantial Completion: The date on which construction is sufficiently complete to permit the school to use or occupy the building. Surety: An insurance company that provides security against loss or damage or for the fulfillment of an obligation, in the case of construction, bid, payment and performance, and stop payment notice release bonds. Warranty: Express or implied promises regarding the quality of the work and material on a construction project. NOTE Definitions are always subject to interpretation and uses depending on the particular terms of a contract. If faced with a dispute, always consult the specific terms of the contract.
