The following table is a list of the statutory requirements for a legally enforceable waiver and release of ADEA claims. The first column is the actual statutory requirement under the OWBPA. The second column provides the correct way to apply the requirement in an actual early retirement incentive agreement. The last column is an example of the wrong way to apply the requirement to an early retirement incentive agreement.
