2. If so, determine whether district has a probationary faculty position for administrator.

 After the March 15 letter and before June 30, send a second letter confirming that the administrator’s assignment will end on June 30. (See Appendix F.) For an administrator on a multi-year contract, this letter must be sent after the six-month notice and before the end of contract unless the contract specifies a shorter notice period.

N ON -A CADEMIC E MPLOYEES

A. C LASSIFIED E MPLOYEES Under the California Education Code, employment in community college districts falls into one of two categories: “academic” or “classified.” Education Code section 87001, subdivision (b) defines academic employment as “every type of service, excluding paraprofessional service, for which minimum qualifications have been established by the board of governors pursuant to Education Code section 87356.” Academic employees, such as faculty members, are part of the academic service. 59 The remaining employees fall into the category of “classified” employees. 60 Education Code section 88003 governs classification in non-merit system districts. Education Code section 88076 governs classification in merit-system districts. In both merit- and non-merit-system community college districts, all positions that are not academic and are not specifically excluded from the classified service under the Education Code must be part of the classified service. 61 Therefore, if a particular non-academic employee does not fall within a specific statutory exemption, you should presume that the employee is to be classified.

Classification means that each position in the classified service has:



A designated title,

 A regular minimum number of assigned hours per day, days per week, and

months per year,

 A specific statement of the duties required to be performed by the

employees in each position; and

 The regular monthly salary ranges for each position.
