1550 Unlike the ADA, California state regulations provide minimum standards for employees who require assistive animals in the workplace, including, but not limited to, requiring that the assistive animal: (1) be free from offensive odors and display habits appropriate to the work environment; (2) does not engage in behavior that endangers the health or safety of the individual with a disability or others in the workplace; and (3) be trained to provide assistance for the employee’s disability. See Cal. Code Regs., tit. 2, § 11065, subd. (a)(2). Also, if an employee requests permission to bring an assistive animal into the workplace as a reasonable accommodation, under state regulations, prior to allowing the animal to be in the workplace, the school may require that the employee supply: (1) a letter from the employee’s health care provider stating that the employee has a disability and explaining why the employee requires the presence of the assistive animal in the workplace; and (2) confirmation that the animal meets the school’s minimum standards for employees who require assistive animals. See Cal. Code Regs., tit. 2, § 11069, subd. (e). The ADA is a floor, however, and preempts any state or local law that puts an additional burden on disabled persons.
