This same language appeared originally in the CFRA, but it was removed because it would be extremely difficult to administer. It is unclear how this language will be interpreted in the current context. Where both parents work and both wish to bond with a newborn or to provide care for their seriously ill child, will one, both, or neither of the parents be eligible for paid family leave? Perhaps forthcoming regulations will clarify the ambiguities in the code. If not, these issues will have to be litigated or, perhaps, addressed in attorney general opinions.
