Chapter 6 – Wage And Hour Laws

Federal law is different from California law in regards to camps. Under the FLSA, a recreational establishment is exempt from federal minimum wage and overtime laws if the establishment is a distinct physical location that “is an amusement or recreational establishment, organized camp, or religious or non-profit educational conference center.” The camp must either:  Not operate for more than 7 months in any calendar year, or  Have receipts for any six months of the preceding calendar year that were not more than 33.3% of its average receipts for the other six months of the preceding calendar year. 561 The idea behind this requirement is that if the camp operates for more than 7 months in any calendar year, more than two- thirds of the camp’s revenue is received during a peak operational season. 562 Employees of an organized camp in California must satisfy both state and federal law, as set forth above, to be exempt from minimum wage and overtime requirements.

A. F EDERAL M INIMUM W AGE R EQUIREMENTS The FLSA establishes the federal minimum wage, which is currently $7.25 per hour. This has been the federal minimum wage since 2009. 563 B. C ALIFORNIA M INIMUM W AGE R EQUIREMENTS In 2016, the Governor signed legislation to raise California’s minimum wage in progressive steps to reach $15.00 per hour by 2022 for schools with 26 or more employees. 564
